Purchase and payment
The agreement between Vonken BV (BE0745732634) and you as the buyer is concluded at the moment you have accepted and complied with the conditions set by Vonken. The absence of a regular signature does not affect the binding force of the offer and its acceptance.
Vonken always confirms the purchase by email. If no confirmation email has been sent, the agreement is not yet in effect. Vonken reserves the right to refuse an order or to subject it to additional conditions, such as in the case of large orders, orders placed by minors, incomplete order procedures, or problems with previous orders.
The seller remains the owner of all goods until full payment has been received. Payment for products purchased from Vonken must be made in advance by bank transfer or via one of the other proposed payment methods.
In the event of late payment, Vonken is entitled to terminate the agreement with immediate effect or to suspend (further) delivery until you have fully complied with your payment obligations.
The General Terms and Conditions and confirmation emails are always written in the language of the website. In accordance with this clause, which the buyer expressly accepts upon conclusion of the agreement, in the event of non-payment on the due date due to negligence, the invoice amount shall be increased by operation of law and without notice of default by interest of 12% per annum on the outstanding amount. In addition, a fixed compensation of 15% of the outstanding amount is payable.

Warranty provisions
Vonken follows the official warranty guidelines of its suppliers.
Warranty claims will be handled at Vonken's expense, except for the shipping costs incurred by the consumer to return the product to us.
Defects
You are obliged to inspect the goods carefully immediately upon receipt. In doing so, you must check whether the goods delivered comply with the agreement:
- Were the correct goods delivered?
- Do the delivered goods meet the agreed quality requirements or, if these are lacking, the requirements that may be set for normal use?
- If a visible defect or shortcoming is found, you must report this to Vonken within 8 working days of delivery.
- The consumer must report any non-visible defect to Vonken in writing by email within two working days of discovery, but no later than two months after delivery.
- The costs for returning goods that do not comply with the description of the offer shall be borne by Vonken.
Force majeure
Force majeure is understood to mean all external causes, whether foreseen or unforeseen, over which Vonken has no influence, but which prevent Vonken from fulfilling its obligations.
Vonken also has the right to invoke force majeure if the circumstance preventing (further) performance occurs after Vonken should have fulfilled its obligation.
During force majeure, Vonken's delivery and other obligations will be suspended. If the period during which Vonken is unable to fulfill its obligations due to force majeure lasts longer than 8 weeks, both parties are entitled to terminate the agreement without any obligation to pay compensation.
Prices
You will be informed of the prices of the goods before checkout. All prices are expressed in euros and include VAT but exclude Recupel, BEBAT, and Reprobel fees. Shipping costs are listed separately.
If Vonken agrees on a certain price with you, Vonken is nevertheless entitled to increase the price.
Offers are valid while supplies last.
If a price increase occurs after the agreement has been concluded, you may terminate the agreement regardless of the percentage of the increase.
A personalized quotation is valid for two weeks, unless a different period is stated in the quotation.
Contracts in which delivery will be made at the buyer's request or in which the buyer collects the goods from the seller themselves will retain the contractually agreed sales price for a maximum of one year. In the case of such contracts, the seller may, if necessary, stipulate a delivery period of one month. If, one year after the date of conclusion of the agreement, the contract has not been performed, the contractually stipulated price will be automatically adjusted to the current price without further notice. Unless otherwise agreed, the contract must be performed within one year of the date of the contract. After that period, the buyer will be deemed to have unilaterally failed to fulfill their obligations and a claim for termination of the agreement will be brought to their detriment or the performance of the agreement will be demanded.
If the buyer fails to fulfill the obligations entered into by contract, the seller shall be entitled to seek the dissolution of the agreement in court. The compensation that will be claimed in this case is contractually set at 30% of the invoice price, unless evidence of higher damages actually suffered can be provided.
Questions and complaints
Complaints or disputes must be reported within 8 days of delivery. If the complaint is found to be justified, our liability is limited to the replacement of the goods. Any liability on the part of the seller is limited to the actual amount paid for the order.
Vonken always handles questions and complaints within a reasonable period of 8 calendar days.
Disputes
All offers and agreements are governed exclusively by Belgian law, excluding the principles of conflicts of law in space.
All disputes relating to or arising from offers made by Vonken, or agreements concluded with it, shall be submitted to the competent court in Kortrijk, unless a mandatory legal provision expressly designates another court as competent.
